By submitting a rental application, you offer to be considered for tenancy on these Terms and Conditions. Submission does not conclude any lease. A binding lease is concluded only by a written lease agreement signed by both you and a duly authorised representative of the Company. No email, SMS, WhatsApp or informal communication concludes a lease.
You warrant that every piece of information, document and statement provided is accurate, current and truthful. Any forged, altered or materially omitted information will result in immediate, final rejection. The Company is entitled to refer fraudulent documents to the South African Police Service for criminal investigation and to list you on credit-bureau and SAFPS fraud registers in accordance with section 72 of the NCA.
The Company is an Accountable Institution under FICA. You must produce certified KYC documentation. The Company is prohibited by FICA s29(3)–(4) from notifying you if it has filed a suspicious-transaction report with the Financial Intelligence Centre. No claim may be made against the Company for compliance with this statutory obligation.
To the maximum extent permitted by law, the Company is not liable for any consequential, indirect, special or punitive loss. The Company's aggregate liability is capped at the higher of the vetting fee actually paid and R5 000. This cap does not apply to loss caused by the Company's gross negligence, wilful misconduct or fraud.
You have the right to access, correct or request deletion of your personal information (POPIA s23–24), to withdraw consent (s11(2)(b)), to opt out of direct marketing (s69), and to lodge a complaint with the Information Regulator at inforeg@justice.gov.za. Nature of this fee. The amount of R 250.00 ("the Vetting Fee") is a fee for services rendered — specifically, the procurement of a credit and background verification report from a registered credit bureau (TPN Credit Bureau and/or TransUnion), together with the administrative costs of evaluating your application. The Vetting Fee is not a deposit, reservation fee, or consideration for any option or right to lease the property.
Consumer Protection Act 68 of 2008 — disclosure. In terms of section 100 of the CPA, you are entitled to a clear disclosure of this fee before payment is made. By signing below, you confirm that this disclosure has been made to you in plain language and that you understand the nature, purpose, and non-refundability of the Vetting Fee prior to any payment being made.
Non-refundability. The Vetting Fee is strictly non-refundable in all circumstances once payment has been received, including but not limited to: (a) withdrawal of your application after payment; (b) your failure to qualify following vetting; (c) your decision not to proceed with a viewing following approval; (d) the property being let to another applicant. The non-refundability of this fee is not an unfair term under the CPA because the fee represents actual costs incurred by the landlord on your behalf, at your request, and the credit bureau report is generated specifically for your application.
No guarantee of viewing or lease. Payment of the Vetting Fee does not constitute an offer to lease, does not entitle you to a physical viewing, and does not create any obligation on the part of Napolitani Investments to conclude a lease agreement. A viewing invitation is extended solely at the landlord's discretion, subject to a satisfactory vetting outcome.
Payment instructions. Following receipt of this completed form, you will receive a payment reference and EFT banking details via email. Do not make payment until you have received these details in writing from info@napolifunds.co.za. Napolitani Investments accepts no responsibility for payments made to any other account.
Responsible party. Napolitani Investments, of 1 Sceptre Crescent, Table View, 7441, Cape Town, South Africa ("the Landlord"), is the responsible party for the purposes of the Protection of Personal Information Act 4 of 2013 ("POPIA").
Personal information collected. The Landlord collects the following categories of personal information: identity and contact information; financial and employment information; credit and delinquency history obtained from TPN Credit Bureau and/or TransUnion; rental history and references; and information about proposed occupants.
Purpose of processing. Your personal information is processed exclusively for the following purposes: (a) evaluating your suitability as a tenant; (b) conducting credit and background screening with registered third-party bureaus; (c) verifying your identity and employment as required by the Financial Intelligence Centre Act 38 of 2001; (d) communicating the outcome of your application; and (e) where a lease is concluded, administering the tenancy. It will not be used for any other purpose without your further consent.
Third-party disclosure. Your information will be disclosed to TPN Credit Bureau and/or TransUnion solely for the purpose of generating a credit report. No further third-party disclosure will be made without your consent, except where required by law.
Retention. If your application is unsuccessful, your personal information will be retained for 12 (twelve) months and thereafter securely destroyed. If a lease is concluded, your information will be retained for the duration of the lease and for 5 (five) years thereafter, in compliance with applicable record-keeping obligations.
Your rights. You have the right to request access to, correction of, or deletion of your personal information, subject to applicable legal limitations, by contacting the Landlord at info@napolifunds.co.za. You also have the right to lodge a complaint with the Information Regulator of South Africa at inforeg.org.za.
